We at nowrun.io know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways.

Remember that your use of the nowrun.io Services is at all times subject to the Terms of Use, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.

If you are a resident of the European Union ("EU"), United Kingdom, Liechtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the "GDPR") with respect to your Personal Data (as defined in the GDPR). In this event, please refer to the "Your Rights if You Are Located in the EU/UK" section below.

What does this Privacy Policy cover?

This Privacy Policy covers our treatment of personally identifiable information ("Personal Information") that we gather when you are accessing or using our Services, but not the practices of companies we don't own or control, or people that we don't manage. We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our services, to allow you to set up a user account and profile, to administer your use of our Services, to process your payments and orders, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below.

As noted in the Terms of Use, we do not knowingly collect or solicit personal information from anyone under the age of 16. If you are under 16, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 16, we will delete that information as quickly as possible. If you believe that a child under 16 may have provided us personal information, please contact us at privacy@nowrun.io.

Will nowrun.io ever change this Privacy Policy?

We're constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on the Privacy Policy page, by sending you an email, and/or by some other means. Please note that if you've opted not to receive legal notice emails from us (or you haven't provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected.

What Information does nowrun.io Collect?

Information You Provide to Us

We receive and store any information you knowingly provide to us. For example, through the registration process and/or through your account settings, we may collect Personal Information such as your email address, user name, and password (stored only in hashed form). If you register or log in using your mobile number, we use it only to send you authentication codes (OTPs) for login verification.

When you make a purchase, we (or our Payment Processor) collect the information necessary to process your order, such as your name, email address, and transaction details. We do not store your full payment card numbers, CVV codes, or bank account credentials — these are collected and processed directly by our third-party Payment Processor.

While using the Services, you may also provide third-party account credentials to log in to third party sites (such as Google, Facebook, or other third party sites) using their proprietary secure login forms. By signing in to a third party site or service through the Services, you understand some content and/or information in those accounts ("Third Party Account Information") may be transmitted into your account with us, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy.

Certain information may be required to register with us or to take advantage of some of our features. We may communicate with you if you've provided us the means to do so. If you do not want to receive communications from us, please indicate your preference by clicking on the unsubscribe or communication preferences link in the emails or communications.

Information Collected Automatically

Whenever you interact with our Services, we automatically receive and record information on our server logs from your browser or device. We may use this data to customize content for you that we think you might like, based on your usage patterns, and to improve the Services. Information we automatically receive may include the following:

1. Device Information: We may collect device-specific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information). We may associate your device identifiers with your nowrun.io account to verify compliance with the Terms of Use and to detect fraud.
2. Log Information: When you use our Services, we may automatically record technical and related information from your device, its software, and your activity using the Services. This may include:
   * The device's Internet Protocol ("IP") address;
   * Identification numbers associated with your devices (or synthetic anonymous IDs);
   * Locale preferences (country-level only);
   * Application or session activity such as start, duration, stop, crashes, network activity, and resource consumption;
   * Device event information such as crashes, system activity, and hardware settings;
   * Date and time stamps associated with events;
   * Purchase transaction history;
   * System configuration information; and
   * Other interactions with the Services and third party services.
3. Cookies: We use cookies and similar technologies (such as pixel tags, web beacons, JavaScript, and local storage) to enhance your experience on our website — for example, to recognize your browser, keep you logged in, remember your preferences, and analyze usage. You may refuse to accept cookies by activating the setting on your browser, but if you do, you may be unable to access certain parts of our website. Please see the "Cookie Policy" section below for more detail.
4. Geo-location Information: When you use a location-enabled app or feature and have opted in to location access, we may collect, process, and retain information about your actual location (for example, GPS). We use location data to provide and improve location-based products and services. By using a location-enabled feature, you consent to us processing information about your actual location. We otherwise use country-level location derived from your IP address.
5. Information Collected From Other Websites and Do Not Track Policy: Through cookies we place on your browser or device, we may collect information about your online activity after you leave the websites of our Services, and otherwise as described in this Privacy Policy. Your browser may offer you a "Do Not Track" option; our Services do not currently respond to Do Not Track signals.

Will nowrun.io Share Any of the Personal Information it Receives?

We do not rent or sell your Personal Information in personally identifiable form to anyone, provided certain Personal Information may be transferred in connection with business transfers, as described below. We may share your Personal Information with third parties as described in this section:

Information that's no longer personally identifiable. We may anonymize your Personal Information so that you are not individually identified, and provide anonymized or aggregate usage information to our partners, who may use such information to understand how often and in what ways people use our Services. We never disclose aggregate usage information in a manner that would identify you personally. We use analytics providers (such as Google Analytics) to monitor and analyze use of our Services; you can opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout.

Agents and Service Providers: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you; for example, we may use third party companies and individuals to help us provide, analyze, and improve our Services (including but not limited to data storage, maintenance services, database management, web analytics, customer support, and payment processing) under obligations to adequately safeguard the information. Unless we tell you differently, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us or perform the tasks on our behalf.

Payment Processors: When you make a purchase, your payment information is collected and processed by our third-party Payment Processor(s). The Payment Processor's collection, use, and storage of your payment information is governed by the Payment Processor's own privacy policy and terms, in addition to this Privacy Policy. We may receive from the Payment Processor limited information about your transaction (such as the last four digits of your card, transaction ID, amount, and status) to maintain your Billing Account and transaction records.

Affiliated Businesses: In certain situations, businesses or third party websites we're affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us). We will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service. We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business' or websites' policies.

User Profiles and Submissions: Certain user profile information, such as your user name and avatar, may be displayed to other users to facilitate user interaction within the Services. Please remember that any content you upload to your public user profile, along with any Personal Information or content that you voluntarily disclose online in a manner other users can view, becomes publicly available and can be collected and used by anyone.

Business Transfers: We may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Compliance with Laws; Protection of nowrun.io and Others: We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to (a) comply with law or court order; (b) enforce or apply our Terms of Use and other agreements; (c) protect the rights, property, or safety of nowrun.io, our employees, our users, or others; or (d) prevent fraud or abuse of nowrun.io, our employees, our users, or others.

Is Personal Information about me secure?

Your account is protected by a password for your privacy and security. If you access your account via a third party site or service, you may have additional or different sign-on protections via that third party site or service. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password and/or other sign-on mechanism appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account. If we receive instructions using your nowrun.io account information, we will consider that you have authorized the instructions.

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, using measures such as encryption of data in transit and access controls on internal systems. But unfortunately, no method of electronic transmission or storage is 100% secure, so we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time.

What Personal Information can I access?

Please keep your information up to date and accurate. Through your account settings or by using features of our Services, you may access, and in some cases edit or delete, the following information you've provided to us:

• user name / nickname
• avatar
• email address

How do I request deletion of my Personal Data?

You have the right to request that we delete the Personal Data that we have collected about you. This right is subject to certain exceptions: for example, we may need to retain your Personal Data to provide you with the Services, to process or refund a transaction, or to comply with legal obligations. If your deletion request is subject to one of these exceptions, we may deny your deletion request.

To request deletion of your Personal Data, you or your Authorized Agent (defined below) must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Data, and (2) describes your request in sufficient detail to allow us to understand, evaluate, and respond to it. Each request that meets both of these criteria will be considered a "Valid Request." We may not respond to requests that do not meet these criteria. We will only use Personal Data provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

We will work to respond to your Valid Request within 30 days of receipt. We will not charge you a fee for making a Valid Request unless your request(s) are excessive, repetitive, or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

You may also authorize an agent (an "Authorized Agent") to exercise your rights on your behalf. To do this, you must provide your Authorized Agent with written permission to exercise your rights on your behalf, and we may request a copy of this written permission from your Authorized Agent when they make a request on your behalf.

California Resident Rights

If you are a California resident, you have the rights set forth in this section. If there are any conflicts between this section and any other provision of this Privacy Policy, the portion that is more protective of Personal Data shall control to the extent of such conflict. Access. You have the right to request certain information about our collection and use of your Personal Data over the past 12 months. In response, we will provide you with the following information:

• The categories of Personal Data that we have collected about you.
• The categories of sources from which that Personal Data was collected.
• The business or commercial purpose for collecting or selling your Personal Data.
• The categories of third parties with whom we have shared your Personal Data.
• The specific pieces of Personal Data that we have collected about you.

Deletion. You have the right to request that we delete the Personal Data that we have collected about you. Please see the "How do I request deletion of my Personal Data?" section above for the deletion request process.

Personal Data Sales Opt-Out and Opt-In. We will not sell your Personal Data, and have not done so over the last 12 months. To our knowledge, we do not sell the Personal Data of minors under 16 years of age.

We Will Not Discriminate Against You for Exercising Your Rights. We will not discriminate against you for exercising your rights under the CCPA. We will not deny you our goods or services, charge you different prices or rates, or provide you a lower quality of goods and services if you exercise your rights under the CCPA. However, we may offer different tiers of our Services as allowed by applicable data privacy laws with varying prices, rates, or levels of quality related to the value of Personal Data that we receive from you.

Under California Civil Code Sections 1798.83–1798.84, California residents are entitled to ask us for a notice identifying the categories of Personal Information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. If you are a California resident and would like a copy of this notice, please submit a written request to: privacy@nowrun.io.

Nevada Resident Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at privacy@nowrun.io with the subject line "Nevada Do Not Sell Request" and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Data as sales are defined in Nevada Revised Statutes Chapter 603A.

Your Rights if You Are Located in the EU/UK

If you are a resident of the European Union ("EU"), United Kingdom, Liechtenstein, Norway, or Iceland, you may have additional rights under the GDPR with respect to your Personal Data, as outlined below. For this section, we use the terms "Personal Data" and "processing" as they are defined in the GDPR. now.gg, Inc. will be the controller of your Personal Data processed in connection with the Services. Where applicable, this section supplements, and does not replace, the rest of this Privacy Policy. If there are any conflicts, the policy or portion that is more protective of Personal Data shall control.

What Personal Data do we collect from you?

• Information we collect directly from you: email address; mobile phone number (if you log in via OTP); user name, nickname, and avatar; user content you submit publicly; billing contact details (name, address) provided on orders; and, if you participate in a promotion, your first and last name, mailing address, telephone number, and photograph.
• Information we receive from third party sources: If you use a third party service to log in to our Services (e.g., Google or Facebook Connect), that service may send us information about you, such as information from your public profile, depending on that service's policies and your account settings.
• Information we automatically collect: IP address; unique device identifiers (or synthetic anonymous IDs); web browser information; session/application activity (start, duration, stop, crashes, resource consumption); transaction information (amount, date and time, purchase history); cookies and similar tracking technologies; location information (country-level); log data (access times, hardware and software information); and other interactions with the Services.

How do we use your Personal Data, and on what legal bases?

We process Personal Data to operate, improve, understand, and personalize our Services — for example: to create and manage user profiles; process orders and payments; communicate with you about the Services; provide support; personalize content; analyze usage; detect and prevent fraud; meet legal obligations; resolve disputes; and enforce our Terms of Use.

• Contractual Necessity: We process your sign-up information (email), account data (nickname, avatar), and billing contact details to perform our agreement with you and provide the Services. Failure to provide such Personal Data may prevent you from using portions of the Services that require it.
• Legitimate Interests: We process analytics data, customer support data, transaction/conversion data, and fraud-prevention data where it furthers our legitimate interests or those of third parties, including operating and improving our business and products, marketing, providing customer support, detecting fraud and security threats, complying with legal obligations, and completing corporate transactions.
• Consent: In some cases we process Personal Data based on consent you expressly grant at the time of collection (for example, optional location access or marketing communications). You may withdraw consent at any time.
• Legal Obligations: We may process Personal Data to comply with applicable law, protect vital interests, or perform tasks in the public interest.

How and with whom do we share your data?

We share Personal Data with vendors and service providers who work on our behalf, including payment processors, fraud prevention providers, analytics providers, hosting providers, and customer support providers. We also share Personal Data when necessary to complete a transaction you initiated, when you have given us consent, and when we believe it is necessary to comply with applicable law or valid legal process, to protect us, our business, or our users, or to maintain the security of our products and services. If we are involved in a merger, acquisition, bankruptcy, or change of control, your Personal Data may be transferred as part of that transaction, and any acquirer may continue to use your Personal Data as set forth in this Policy.

How long do we retain your Personal Data?

We retain Personal Data about you for as long as you have an open account with us and for up to 12 months after you close your account. Transaction and billing records may be retained longer where required for tax, accounting, or legal purposes. Afterwards, we retain some information in a depersonalized or aggregated form, not in a way that would identify you personally.

What security measures do we use?

We seek to protect Personal Data using appropriate technical and organizational measures, including encryption of data in transit and identity and access management for internal systems.

What rights do you have regarding your Personal Data?

• Access: You can request more information about, and a copy of, the Personal Data we hold about you.
• Rectification: You can request that we correct or supplement Personal Data that is incorrect or incomplete.
• Erasure: You can request that we erase some or all of your Personal Data from our systems.
• Withdrawal of Consent: Where we process based on your consent, you may withdraw it at any time (this may limit your ability to use some features).
• Portability: You can ask for a copy of your Personal Data in a machine-readable format, and request we transmit it to another controller where technically feasible.
• Objection: You can object to certain uses of your Personal Data, such as direct marketing.
• Restriction of Processing: You can ask us to restrict further processing of your Personal Data.
• Right to File a Complaint: You have the right to lodge a complaint about our practices with the supervisory authority of your country or EU Member State.

Transfers of Personal Data. The Services are hosted and operated in the United States ("U.S.") through us and our service providers. By using the Services, you acknowledge that your Personal Data will be hosted on U.S. servers, and you authorize us to transfer, store, and process your information to and in the U.S. and possibly other countries. Where we transfer Personal Data from the EEA, UK, or Switzerland to countries that have not been deemed adequate, we rely on appropriate safeguards such as Standard Contractual Clauses or the UK International Data Transfer Agreement/Addendum.

Cookie Policy

The Services use cookies and similar technologies (such as pixel tags, web beacons, clear GIFs, JavaScript, and local storage). We use them to: (a) enable essential features such as keeping you logged in and processing your shopping cart/checkout; (b) recognize you when you return and remember your preferences (such as language); (c) understand how visitors use the Services, including which pages are viewed and for how long, and measure the performance of our features; and (d) where applicable, deliver relevant advertising. We use Google Analytics, a web analysis service provided by Google; on our behalf, Google uses the generated information to evaluate your use of the website and compile reports on website activity. To opt out of Google Analytics across all websites, visit https://tools.google.com/dlpage/gaoptout.

You can control and/or delete cookies as you wish — for details, see www.allaboutcookies.org. Most browsers allow you to refuse cookies or to accept each cookie individually; if you do so, some features of the Services may not work properly. Third parties (including advertising partners and analytics providers) may also transmit cookies to your device when you interact with their content through the Services; this Privacy Policy does not cover the use of cookies by any third parties. Some of our cookies are "session cookies" (temporary) and others are "persistent cookies" (stored for a period of time). Our Services do not currently respond to "Do Not Track" browser signals.

What choices do I have?

You can always opt not to disclose information to us, but keep in mind you may need to provide some information to us in order to take advantage of some of our features. You may add, update, or delete information as explained above; when you update information, we may maintain a copy of the unrevised information in our records. You may stop using our products by disconnecting your third party accounts from our Services or uninstalling our software from your devices; after you do so, we do not have access to or control over the contents or information in your third party accounts. We will retain your information for as long as your account is active or as needed to provide you with Services or as required by law (whichever is longest). We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may use aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.
